Stearns Weaver Miller’s E-Discovery and Information Management practice group is heavily involved in virtually all of our Firm’s litigation cases and also provides strategic consulting for many of our corporate clients.
Electronic data is integral to every aspect of our clients' businesses, from e-mails to data storage in its endless forms. The recent explosion in data creation and storage capabilities - which continues to increase at a parabolic rate - has created new and unique challenges in the litigation discovery area, and in the maintenance of corporate internal electronic information policies, procedures, and best practices.
The significant challenge presented by discovery of electronically stored information has resulted in new obligations and standards of conduct for attorneys under governing rules and case law. In December of 2006, the Federal Rules of Civil Procedure were amended to reflect that electronically stored information, including email, is discoverable and also set forth various specific obligations of parties in litigation with respect to the preservation and production of electronically stored information. While these rules currently apply only in federal cases, it is expected that states will adopt similar rules. Florida established a Civil Procedure Rules Subcommittee on Electronic Discovery which plans to recommend that Florida's rules regarding electronic discovery mirror the federal rules.
E-discovery and information management have become a component part of most of our litigation cases. To the extent that litigation results in any issue that deals with a client's or opposing party's email systems and electronic document systems, the E-Discovery and Information Management practice group is tasked with the proper handling of e-discovery issues, and is responsible for strategic e-discovery gathering, e-discovery processing, and workflow management.
For our corporate clients, the E-discovery and Information Management practice group assists with the implementation and maintenance of the policies, procedures, and best practices required for the effective handling of electronic information.
