Stearns Weaver Miller’s Appellate practice represents clients in complex appellate litigation in both state and federal courts. Because much of our appellate practice includes clients whom we represented in the lower courts, not only are we familiar with all the nuances of the case, but we also make every effort to ensure that the initial trial arguments are properly preserved for appeal. Additionally, we are often retained specifically to handle the case at the appellate level.
Our appellate cases include labor and employment law, intellectual property law, commercial and business litigation, and medical malpractice, among others. We represent a wide array of industries including pharmaceutical, automotive, healthcare and construction. We have won federal and state appeals; and in many cases the appeals have been ground breaking, prompting changes to the law.
Our attorneys are skilled at presenting constitutional, statutory and common law claims. We have experience preparing writs of appeals, seeking extraordinary relief and preparing amicus curiae briefs. We are also regularly involved in evaluating the prospects of an appeal and assisting in appellate mediation.
